These Terms of Service (the "Terms") are an agreement between you and YMV Interactive ("HushAffair", "we", "us"), the operator of hushaffair.com (the "Site"), based in Montreal, Quebec, Canada. By creating an account or using the Site, you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
HushAffair is a website for adults who want to meet other adults for discreet relationships, including people who are married or in a relationship. Your relationships and the decisions you make are your own responsibility.
We do not verify members' identities, ages, marital status or the information in their profiles, and we do not run background checks. Please use your own judgment when you deal with other members:
Purchases are not automatically refundable. If you believe you are owed a refund, for example because of a billing error, or a technical problem that stopped you from using a membership you paid for, contact us through our contact form with your username and your PayPal transaction ID. We review each request individually and may grant a full or partial refund at our discretion. This section does not limit any refund rights you have under consumer-protection law.

We may remove content, and restrict or close accounts, that break these rules.
You keep ownership of the photos, text and other content you post. You give us a non-exclusive, worldwide, royalty-free licence to store, display and format that content on the Site, only as needed to operate the Site. This licence ends when you delete the content or your account, except for copies held in backups (see our Privacy Policy) and messages other members have already received.
You confirm that you have the right to post your content and, for any photo showing other people, their consent. We may review, moderate or remove content, but we have no obligation to monitor everything posted on the Site.
Our Privacy Policy explains what personal information we collect, how we use it, who we share it with, and your rights.
By you. You can delete your account at any time from your account settings, or ask us to delete it. Unused membership time and credits are not refunded, except as described in section 5.
By us. We may suspend or close your account if you break these Terms, if the law requires it, or to protect other members or the Site. We will usually tell you why, unless the law or someone's safety prevents it. If we close your account because you broke these Terms, unused membership time and credits are not refunded.
We may change, add or remove features. We work to keep the Site available, but it may sometimes be unavailable for maintenance or because of technical problems, and we do not guarantee uninterrupted access.
The Site is provided "as is" and "as available". We do not guarantee that you will meet anyone, or that any member is who they say they are. We are not responsible for how other members behave, on or off the Site. Services provided by third parties, such as PayPal, WhatsApp or third-party sign-in, are governed by their own terms.
To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, reputation or opportunity, arising from your use of the Site. To the extent permitted by law, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms excludes or limits any liability, or any right you have, that cannot be excluded or limited under the law that applies to you, including consumer-protection law.
To the extent permitted by law, you agree to compensate us for claims brought by third parties that arise from your breach of these Terms or from content you post.
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. If you have a dispute with us, please contact us first so we can try to resolve it informally. If we cannot resolve it within 30 days, either of us may bring the dispute before the courts of Quebec, Canada, unless the law of the place where you live gives you the right to bring it before your local courts.
We may update these Terms. We will post the new version on this page with a new effective date and, for significant changes, tell you in advance by email or by a notice on the Site. If you keep using the Site after a change takes effect, you accept the updated Terms. If you do not agree with a change, please stop using the Site and delete your account.
